DFB rules for players' agents "partially ineffective"

The Cartel Senate of the Frankfurt / Main Higher Regional Court (OLG) has declared parts of the DFB rules for players’ agents to be ineffective. Tuesday’s ruling relates to a legal dispute between the German Football Association (DFB) and the Rogon agency.

According to the OLG, based on the so-called “Meca-Medina decision” of the European Court of Justice (ECJ), “the obligation to register, the obligation to disclose remuneration and payments and the prohibition of fee payments to players’ agents for the placement of minors” are justified.

On the other hand, however, “the obligation of the players ‘agents to submit to all regulations of FIFA and the DFB and the prohibition of the percentage participation of the players’ agent in a further transfer in certain contractual constellations cannot be approved from an antitrust point of view”.

However, the OLG decision is not yet legally binding. The Senate has approved the appeal to the Federal Court of Justice (BGH) because of its “fundamental importance”.
